Clear Channel Broadcasting, Inc. and its subsidiaries and affiliated companies, (together, the “Company”), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:
The Company may conduct the Contest concurrently and simultaneously on several participating radio stations owned and not owned by the Company, in the California market, and the Company may add or remove participating stations or change call letters of any participating station at any time during the Contest as announced on the affected station. Participating stations are listed above:
1. Description of Contest/Participation.
A. Dates of Contest: The Contest will begin on Thursday, May 21, 2009 at 12:00pm and end on or about Monday, September 7, 2009.at 11:59pm
NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of entrants and the number of entries received.
B. How to enter:
Individuals 18 years or older and legal residents of Southern California must complete the following submission steps to be officially entered in the contest:

How to play:
Each entrant will be prompted to enter their instant win code from the Blue Oval. Green Beaches promotion card that they obtained from the Street Teams Beach events for the chance to win various prizes. Twelve (12) instant winners will win a single key for the chance to win their Ford accessorized vehicle. Prize Summer Beach Event Dates can be found online at blueovalgreenbeaches.com and fall with the dates May 22 – August 26, 2009.
If the instant win code is the instant winner, the listener will then be prompted to fill out the online entry form to claim their prize. Once the online entry form is complete, the participant will be considered “entered” in the contest.
The Grand Prize Event will take place on August 29, 2009 at the Santa Monica Pier from TBD PM. At approximately TBDPM each qualifier present will check in with their confirmation and randomly select a single key provided by the Stations. Twelve (12) qualifiers will be given an be given an opportunity to try to start a vehicle with their key until a winner is determined The first qualifier whose key starts the vehicle will be declared the Grand Prize winner and the contest will officially end. Qualifiers must be present to win. No substitutes or stand-ins will be allowed.
Winner must possess a valid driver’s license and show proof of automobile liability insurance and/or other state automobile insurance requirements prior to taking possession of the prize. Winner must possess state authorized identification prior to being awarded the prize and must sign company’s affidavit and paperwork.
The deadline for all instant code entries is at 11:59PM on Sunday, August 23, 2009.
By providing the entry elements described above, and officially entering this contest, individuals agree to: allow the Station to broadcast on-air and online all information provided for the purposes of promoting the contest, and accept and acknowledge the rules, regulations, restrictions and prize description “as is.”
The Prize winners will be randomly selected and notified on Monday, August 24, 2009.
2. Prize(s). The prize(s) that may be awarded to the eligible winner(s) are:
Preliminary Prizes: Twelve (12) winners will receive various Green prizes and each will receive a single key for the chance to win winner’s choice of a 2010 Ford Fusion Hybrid, 2009 Ford Focus PZEV, 2009 Escape Hybrid or 2009 Ford Flex. Valued up to $35,000.
ONE (1) GRAND PRIZE: Winner’s choice of the available four vehicles (2010 Fusion Hybrid, 2009 Focus PZEV, 2009 Escape Hybrid or 2009 Ford Flex) - Approximate Retail Value (“ARV”) not to exceed $35,000 based on the 2009 Manufacturer’s Suggested Retail Price, plus up to $5,000 towards vehicle accessories. Accessories may vary.
ELEVEN (11) RUNNER-UP PRIZES: We will award each runner-up participant a gas card valued at $250.00.
GENERAL PRIZE RESTRICTIONS: Winner is responsible for registration, license, title and insurance fees and for all costs associated with any available upgrade/option packages and any other expenses related to the acceptance and use of the prize not specified herein. Winner must take delivery of vehicle within 30 days of notice of availability from Sponsor-selected dealer near winner’s residence and will be responsible for registration, license, title and insurance fees and cost of any available optional equipment not provided with vehicle. Winner must a have valid U.S. driver’s license and proof of insurance to take delivery. Vehicle color, options and equipment will be determined by Sponsor in its sole discretion. Vehicle or any part thereof may differ from any prize shown in promotional materials and may not be transferred or assigned. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion. Winner will be responsible for all taxes (not limited to federal, state, local and/or income) on prize and will be required to provide his/her Social Security number for tax reporting purposes. Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the fair market value of prize. The prize elements will be awarded as described herein (subject to legal restrictions, etc).
The elements of the Prize are non-transferable, redeemable for cash or exchangeable for any other prize.
If the winner is disqualified or is found to be ineligible for the contest, the Station reserves the right to determine an alternate winner or not to award the prize, at its sole discretion.
All prizes must be redeemed within thirty (30) days of being notified by the promotions department that the prize is available for pick up unless otherwise specified at the time of winning. If a winner fails to pick up a dated prize in time to redeem the benefit, the winner forfeits the prize and no other prize will be awarded in its place. If a winner cannot be contacted or is disqualified, The Company reserves the right to determine an alternate winner or to not award that winner’s prize, in its sole discretion. All prizes must be accepted as awarded. The Company retains the right to substitute a prize with another similar prize of equal or greater value in the event the original prize offered is not available due to circumstances beyond The Company’s control. Vehicle delivery will take place at a dealership selected by Ford Motor Company. If prizes are to be mailed, they are to be sent to winners via standard United States Mail service, unless otherwise noted. Inability of winners to accept the prizes will result in forfeiture. Certain prizes may require winner to be 18 years of age or older, or have signed permission of parent or legal guardian to accept the prize.
Prizes can be picked up at The Company business office (address above) between the hours of 9AM and 5PM ONLY. The Company business office will be closed on weekends and all major holidays.
3. Eligibility and Limitations. Participants and winner(s) must be U.S. residents at least 18-years old as determined by the Company and are legal residents of the Station’s Total Survey Area (TSA). Participants must have and be able to present official state ID to contest officials before the prize will be awarded. Only one (1) entry per person per event. Limit one (1) prize per household. Employees of the Company, Ford Motor Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
4. Telephone and Delivery Disclaimer. If a contest is a call in to win contest and/or a telephone is needed to participate in the Contest, participants are restricted to the use of ordinary telephone equipment. Participants that enable the “Caller ID” block function will not be allowed to participate unless they enter their correct area code and telephone number if prompted, or disable the features inhibiting their participation in the Contest. Participants using equipment not set up for toll free phone exchanges (800, 888, 877, 866, etc.) may experience call connection problems. The Company disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company’s control, or otherwise. For all contests the Company disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. Entry forms in a register-to-win contest must be handwritten. No photocopies or mechanical reproductions of entry forms is permitted.
5. Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, video tapes and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
6. Release. By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, Ford Motor Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
7. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which are not specifically provided for in the official rules. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
8. Conduct and Decisions. By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Miscellaneous. Each winner must submit proof of eligibility and sign the Company’s affidavit and release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, visit the business office of the Station during normal business hours or mail a written request with a stamped, self-addressed return envelope to the Station’s address, listed above. All entries become the property of the Company and will not be returned. 10. Compliance with Law. The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
11. Clear Channel Communication will indemnify, protect, defend and hold harmless Team Detroit, Inc, Ford Motor Company Division (“Ford”), its dealers, affiliates, subsidiaries, agencies, and assigns and its officers, directors, employees and any individual action on its behalf, from and against any and all claims, actions, demands, losses, liability and damages, as well as any amounts paid as a result of a judgment, or settlement, and any reasonable attorneys fees, incurred by Ford as a result of any breach, or nonperformance by Clear Channel Radio Los Angeles of any services or obligations related to or arising from the Sweepstakes and the production of the Sweepstakes.
12. Upon winning any prize from The Company, the contestant, their family members and members of their household (meaning those sharing the winner’s same information- address and/or phone numbers) are no longer eligible to win any prize from The Company (meaning any of the 8 Clear Channel Los Angeles Radio Stations- KYSR, KBIG, KOST, KIIS, KHHT, KFI, KTLK and KLAC) within a sixty (60) day period following the first win. Upon winning a prize valued at $1,000 or more or winning a trip, the household may not win a second trip or prize within a one (1) year period following the first win.
13. The Company retains the right to amend these rules and regulations at any time for any reason.
